When multiple physicians become involved in the treatment of a patient can be very important for them to relay critical diagnostic and recommended follow-up and treatment recommendation to the patient and to the other physicians. The importance of such communication is not negated simply because the patient does no return to one of the physician. A failure to do so may lead to an undiagnosed or untreated disease or condition. And it may constitute medical malpractice.

One such situation arose in the following case: Several doctors had an opportunity to diagnose their male patient’s prostate cancer while it was in its early stages. The patient first saw his primary care physician, a general practitioner, with urinary problems when he was 56 years old. The general practitioner concluded that the problems were not related to cancer although no testing was done to rule out cancer. Ten months later the patient consulted with a urologist who performed a digital examination on the prostate gland and ordered a PSA blood test. As it turned out this urologist was not an approved provider under the patient’s insurance and so the patient consulted with a second urologist.

The approved urologist also conducted a physical examination of the prostate but did not find any abnormalities and so concluded that the patient did not have cancer. The approved urologist did not order a PSA blood test. The one ordered by the first urologist came back and that urologist recommended a biopsy. Unfortunately, that recommended did not get communicated to the family doctor or the urologist approved by the insurance company.

As such the cancer went undiagnosed for two years at which time it had spread beyond the prostate. The physicians treating the patient’s cancer concluded that he likely had only one to five years to life as a result of the cancer’s spread. The law firm that handled this matter reported that they were able to achieve a settlement during jury selection at trial in the amount of $2,500,000 on behalf of the patient.

Here, neither the general practitioner nor the approved urologist ordered a PSA test to screen the patient for prostate cancer. An abnormally high result would have suggested the possibility of cancer. The general practitioner also failed to perform a digital examination to determine whether there was any palpable abnormality to the prostate gland. The second urologist conducted a digital examination but failed to pick up any abnormality of the gland. The second urologist thus relied on only one test – a test that is unreliable for two main reasons. First, the digital examination only allows access to part of the prostate. If there is an abnormality to the part of the gland that cannot be reached during the examination the abnormality will not be found. Second, the digital examination is only as good as the sensitivity of the physician conducting it to detect an abnormality.

As per the case, seeing multiple physicians can lead to multiple errors. The first was the general practitioner and the approved urologist not following the screening guidelines. The other was a communication error when the findings, suspicions, and recommendations of the urologist unapproved by the insurance company was not communicated to the patient or the other urologist. If the patient had been able to keep seeing the unapproved urologist the patient would have known that cancer was a possibility and that a follow up biopsy was in order. The result: multiple physicians consulted yet the diagnosis of prostate cancer delayed followed by a lawsuit.

Cancer is a terrible disease. Treatment for cancer, often including surgery, chemotherapy and/or radiation therapy, can itself be hard on the patient. This, in turn, lead to a blood infection which ultimately took her life. Her last few months included horrific suffering.

The patient was survived by her husband of thirty-nine years and their 2 sons. They filed a wrongful death lawsuit alleging medical malpractice – namely, the deadly overdose of radiation. Their lawyer reported that the case settled for $7.5 million.

The families of those diagnosed with cancer often suffer greatly. The worry and sadness that accompanies the diagnosis of a spouse, a child or a parent can be devastating. Family members often become the caregivers of their loved as they undergo treatment. And they put their trust and their faith in the doctors and other health care professionals in care of their loved one’s treatment.

Add to that the horrible guilt and anguish that can come if they find out that the trust and the faith they placed in the doctors and other health care providers was broken. There are tests that allow the detection of certain types of cancers before the patient becomes symptomatic. The idea is to diagnose the cancer in the early stages while treatment can be used to cure the cancer rather than wait until the cancer advances and spreads and is no longer curable. With respect to prostate cancer there are two tests that are recommended to be used in combination. The first is a physical examination of the prostate gland for any abnormalities that could be the result of prostate cancer. The second is a blood test called the PSA test. An abnormally high result indicates the possibility of prostate cancer.

When a factor other than prostate cancer causes the PSA level to raise the elevated PSA is called a “false positive.” A biopsy has risks, such as the risk of infection and the risk of excessive bleeding. Given these two facts some doctors advise that male patients follow a plan of “watchful waiting.” Under such a plan the doctor monitors the patient’s elevated PSA over a period of months or years. During this time some doctors advise that the patient try non cancer related treatments, for example, for infection, under the theory that if the PSA is elevated for a reason other than prostate cancer such treatments may bring the PSA back to normal levels.

The danger with doing this is that the physician may wait too long before ordering any tests to determine whether the high PSA level is due to prostate cancer. If waiting results in the spread of the cancer beyond the prostate capsule then the patient will no longer have treatment options that can eliminate and cure the cancer. For patients whose cancer is detected while contained within the capsule, the likelihood is better than 90 percent that they will still be alive 5 years after diagnosis. The percentage is lower for the most aggressive forms of prostate cancer. This measure is referred to as the 5-year survival rate.

Doctors use the five year survival rate to classify, for each stage of the cancer at the time of diagnosis, the percentage of men so diagnosed who will survive the cancer for five years. While men with very aggressive forms of prostate cancer generally have a lower survival rate than men with a less aggressive cancer, when prostate cancer is diagnosed in the early stages, before it has a chance to spread outside the prostate gland itself, the five year survival rate is in the high ninety percent range.

When the cancer is not diagnosed until the late stages, after it has spread outside the prostate, there is no known cure at the current time. Treatment options are more limited and are generally meant to slow the spread and effects of the cancer. In time, however, current treatments for advanced prostate cancer eventually lose their effectiveness and the disease becomes fatal.

After the cancer spreads beyond the capsule, the 5-year survival rates drop significantly.
In general, once the cancer reaches to stage 3 the patient has about a 50-50 percent chance that the cancer will progress. If the cancer is already at stage 4 when the diagnosis is made, the patient generally only has a 2-3 year life expectancy.

Treatment options for advanced prostate cancer may include hormone therapy, radiation therapy, orchiectomy (the surgical removal of the testicles), and possibly chemotherapy. Treatment will usually cause the PSA to drop significantly. Over time, however, treatment ceases to be effective as the cancer continues to progress. This is typically associated with a new rise in the PSA level. After the treatment stops being effective, the cancer is fatal. As of the time this article was written approximately 90,000 men a year are expected to die in the U.S. from advanced prostate cancer.

How many of these 90,000 deaths will be due to a physician advising his patient to follow a plan of “watchful waiting” and then waiting too long to finally diagnose the cancer? We might never know how many of these men’s lives might have been saved had the physician instead advised the patient to undergo a biopsy.
